IN NO EVENT SHALL THE AGGREGATE LIABILITY OF OC WELLNESS CARE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU DONATED TO OC WELLNESS CARE IN THE PAST SIX MONTHS.

You agree to defend, indemnify, and hold harmless OC Wellness Care, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Services.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of California in each case located in Orange County.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Entire Agreement: These Terms constitute the entire agreement between you and OC Wellness Care regarding our Services and supersede all prior and contemporaneous written or oral agreements.

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
